Trademark Lawsuit Leaves Some With Sour Taste

The world of copyright and trademark just got a bit more interesting as a $16 million lawsuit makes its way through the courts in Florida.

At issue the company Sweet Pea Limited, Inc. filed a complaint claiming that 52 companies or individuals located throughout the United States were violating their trademark. Contending that using the commonly used words “Sweet Pea” in any form — not just their stylized version — on any article of clothing is in violation of their trademark rights. Where the case turns interesting, is that missing from the list of 52 are any large defendants. All the companies being sued are one-person businesses.
