Lib. of Congress Petitioned to Revoke Licenses

birdie writes “Earthtimes reports that “James H. Billington, Librarian of Congress was petitioned by Media Rights Technologies (MRT) to revoke all statutory internet broadcasting licenses granted under Section 114 of U.S. Copyright law for webcasters who are in violation of that section by willfully distributing their content as an interactive service. These webcasters, including Yahoo, Clear Channel, iTunes, Napster, Rhapsody, MSN Music, Pandora, and Live 365, all enable the public to receive program transmissions that can be unlawfully recorded and deaggregated for purposes of redistribution.””

    The Librarian of Congress has the power to do that
    I would have thought that was the FCC from my small knowledge of US Law.
    Am I wrong?

    Yes. Copyright issues are an LC matter. FCC has nothing to do with that now and never really did. Regulation of indecency is a whole different matter anyhow…

    I was thinking along the lines of it being the transmission element that could be the FCC’s area but interesting to know that the LC is the arbiter of Copyright in the US.

    To be fair the 2 main examples of the FCC for me are the film Pump Up The Volume and one episode of Family Guy 😉

    If anything the problem is terminology. The FCC does not license anything on the web. It tries to stay as far as possible away from that. The term license is also used relative to copyright permissions and copyright royalties. I think, in the end, that is where most of the confusion erupts.
