Interesting day for free speech

Fang-Face writes “The U.S. Supreme Court has refused to hear three cases with strong free speech implications. The story is at the First Amendment Center. The three cases are the suit by Tony Twist against Todd McFarlane, creator of Spawn, a book about the JonBenet Ramsey murder called The Death of an Innocent, and a suit against a junk fax law.“

    Junk Faxes
    There is a federal law that prohibits sending junk faxes. There is good reason for this law. If you stand on a street corner and yell your views it cost me nothing. When you send a junk fax it uses my paper and ink to send your message. The original lawsuit was to fight the federal law that bans junk faxes. The junk faxers lost at the appeals court level and the Supreme Court has refused to hear their case. Fax.com has complained that they are being run out of business. Yes you are! Because you are engaged in a business of spending other peoples money by using their supplies. You have a right to free speech just not with my paper.

    Is This Good News Or Bad News?
    There is not enough information. So McFarland lost? fax lost? and The housekeeper lost?
    Bad news, good news, bad news?

    Any other big cases coming up we should be watching for?

    Nobody has lost yet. Important piece of law. Just because the Supreme Court refuses to hear a case it does not mean they agree with the lower court. The Supreme Court is often looking for a case that has the fact pattern they want if they want to change the case law. The Supreme Court could hear a case similar to all of the ones listed in the future and agree with them all.
