The ad maker said he was related to most of the subjects and thought therefore it would be OK to use the photos. That doesn’t make much sense or sound like a good reason. However, Eugene Volokh of The Volokh Conspiracy (June 3) has an interesting and detailed description of why this probably is “fair useâ€? and not “copyright infringement.â€?”

How someone with a law degree can claim “even the men who are not in the ad have a right to demand the picture not be used” with a straight face is beyond me. It’s gotten those men some decent press coverage, however…..

I think that was a different ad–but I agree, the copyright thing seems weak. I believe Volokh also commented on that one.
